2. What is this App for? The App provides a convenient platform for the public to submit complaints, comments, feedback, suggestions, and inquiries regarding the services offered by Penang State Government. The information is then processed by the relevant government departments to assess the issue raised and to facilitate prompt responses and resolutions, thereby improving government services and ensuring transparency and accountability. The App is a software application designed for recording, monitoring, and reporting your submissions in accordance with the Regulations. Your submissions via the App provide the necessary information for monitoring, tracing issues, and other purposes as stated in paragraph 6. You acknowledge that it is your responsibility to provide accurate information. If you are submitting information on behalf of others, such as names and contact details, you must obtain their consent for disclosure, inform them that their information may be used for these purposes, and notify them that the relevant authorities may contact them if necessary. All information will be handled in accordance with the PgGOV ePINTAS Privacy Policy. |
3. Must I download and use this App? This App is voluntary. You are not required to use it, but if you choose not to, you can still engage with Penang State Government through other official channels. However, using this App provides a more streamlined and efficient way to lodge complaints and provide feedback. |
4. Who owns the App and who should use it? This App, along with its technology, functionality, and services (“Services”), is operated by Penang State Government for public use. The App is intended for individuals interacting with Penang State Government. |
5. Are there any other policies I should refer to? The terms outlined here, along with the PgGOV ePINTAS Privacy Policy and other relevant guidelines and policies, form the basis of the agreement between you and PgGOV ePINTAS. By using or accessing this App, you agree to these Terms. The ePINTAS Privacy Policy, which outlines how ePINTAS collects, processes, holds, discloses, and uses personal information, can be found at https://epintas.penang.gov.my/fr_terma.php. The information ePINTAS collects from you is used for the purposes set out in Section 6 and will be held in accordance with PgGOV's Privacy Policy. By using or accessing this App, you agree that ePINTAS may collect, use, hold, and disclose personal information as set out in these Terms and in the ePINTAS Privacy Policy. You also confirm that you have informed any persons named by you as your close contacts (see Paragraph 6) of the ePINTAS Privacy Policy and obtained their consent to disclose their information. |
6. What does the Government do with the data collected via this App? The information collected is used for monitoring and responding to public feedback, tracing issues, and ensuring government accountability. Your submissions will provide the necessary information to facilitate issue monitoring and prompt responses. Additionally, the information collected via the App is used to validate any applications, requests, or inquiries you make with Penang State Government. If necessary, ePINTAS may also share your information with other relevant authorities as required by law. |
7. How do I access the App? Once you download this App from an App Store, you need to register as a user within the App. A valid ID and your current, valid contact information are required for user registration. You are responsible for ensuring that the information you provide is accurate and for reviewing and updating your user profile if there are any changes. Your information will be saved locally in the App and in a data center maintained or managed by the Penang State Government. Your right to use the App and the Services will end automatically if you violate the terms of use. Penang State Government also reserves the right to revoke your access or discontinue your use of the App at any time. |
8. Confidentiality You must remember that the App is provided as part of Penang State Government’s public service policy. Any data obtained from using the App is confidential, and access is exclusively intended for the personal use of the user concerned. You are obliged to maintain confidentiality regarding the access data and to prevent unauthorized use of the App by third parties. Therefore, you must not share your access data, including your password, with anyone, even family members or colleagues. If you become aware of or suspect any misuse of your access data, you must inform Penang State Government immediately. In the event of misuse or suspected misuse of your access data, Penang State Government is authorized to block access to the App immediately. All access using your access data will be treated as your own, and you will be responsible for any consequences resulting from third-party use. |
9. Use of the App The Services are provided to facilitate public engagement and improve government services. Therefore, you must not provide false or misleading information, and failure to comply with the Terms may result in action being taken. All use must comply with applicable laws or any orders or requirements of a governmental body or court order. You acknowledge that Penang State Government has the right, but not the obligation, to monitor your access to or use of the Services. You are granted a non-transferable, non-exclusive, revocable license to use the App on your device. This is a limited license, and all other rights are reserved by Penang State Government. Nothing herein grants you any license or title to a copyright, patent, trademark, or other industrial property right. Penang State Government reserves the right to temporarily or permanently lock your access to the App in the event of any breach of the Terms. A breach includes, but is not limited to, providing incorrect details in the User Profile, unauthorized sharing of your access data (especially your password), and/or misuse of the content and applications made available by Penang State Government. If your access to the App is temporarily suspended or terminated, you will still be able to engage with Penang State Government through other official channels. Your access to the App depends on telecommunications, internet service providers, your device’s technical specifications, and other external factors. Access to the App at all times is not guaranteed. Penang State Government will use reasonable skill and care in providing the Services but does not warrant or undertake that the contents created by you in the App and any locally saved versions of documents will not be subject to inadvertent damage, corruption, or loss. Penang State Government reserves the right to delete your data in accordance with the Terms. The design of the App (except for standard app elements), as well as the text, images, graphics, layouts, sounds, animations, videos, and databases contained therein, are copyright protected or subject to other laws protecting intellectual property. Penang State Government holds these rights unless otherwise specified. Penang State Government does not warrant or represent the accuracy, completeness, or currentness of the information contained within the App, including but not limited to the page contents, published documents, and the absence of viruses. Any liabilities arising from making the App available or related to its use are excluded. Penang State Government reserves the right to change the Terms at any time. The formation, interpretation, and operation of this agreement, and any dispute or claim arising out of or in connection therewith, shall be governed and construed in accordance with Malaysian law. Each party irrevocably submits to the exclusive jurisdiction of the courts of Malaysia. If any provisions in these Terms are deemed void or unenforceable, or become completely or partially void or unenforceable, it will not affect the validity of the remaining provisions. A legally valid provision that closely matches the void or unenforceable provision will replace it. In the event of any conflict between the English version and the Malay version, the English version shall prevail. |
